Ivano-Frankivsk diocese challenged in court the transition of communities of the UOC-KP

The clergy of the UOC challenged in court the legality of decisions of meetings of religious communities in the villages Ostrowiec and Staryi hvizdets ‘ on the transition to the UOC-KP.

The priest of the temple of the Church in the Carpathian village Ostrowiec, refused to open proceedings, while in a similar case in the village of Staryi hvizdets ‘ the judge ruled that the village head had exceeded its authority. About it reports “Kurs”.

The rector of the Church after the Church of the assumption of the virgin Staryi hvizdets ‘ Kolomyia district, Archpriest Nikolay Kushnir filed a lawsuit against the head of the village Council Mikhail Diakov in connection with his illegal actions on adoption of the minutes of the General meeting of members of a religious community.

The judge of the Ivano-Frankivsk district administrative court Igor Panikar 26 Dec 2018 issued the decision according to which the village head, as the officer had no right to sign the minutes of the meeting of a religious community.

“According to the court, by affixing the minutes of the General meeting of the religious community of the Ukrainian Orthodox Church in village Staryi hvizdets’ personal signatures and seal of Starokozache village Council and identifying himself as a “village head”, the defendant, by exceeding the powers granted to him, made in a certain way interference in the internal Affairs of religious communities from the state, which is unacceptable,” wrote in the decision the judge Panikar.

The decision in the register published on 2 January. It can be appealed to the appeal within 30 days.

The Abbot of the temple of St. George in the village of Ostrowiec Horodenkivsky district Archpriest Nikolai Bogachenko 17 December 2018 judge of the same court Sergey Ostapyuk refused to open proceedings. “The plaintiff claims not to be an independent subject of legal proceedings and generally are not subject to judicial proceedings”, – stated in the decree of the court.

As reported by SPM on 22 October 2017, in the village of Ostrowiec Horodenkivsky district, Ivano-Frankivsk region, representatives of the Kyiv Patriarchate demanded the community of the Ukrainian Orthodox Church the possibility to hold a service in the Church of the UOC in honour of St. George. In order not to provoke conflict, the community of the UOC did not open the temple and officiated at the walls of the Church.

Community of the UOC of the village of Staryi hvizdets ‘ November 2017 is forced to pray in temporary premises: their Church was captured by the representatives of the UOC-KP. In connection with the illegal transfer of the Church of the assumption in property of the Kyiv Patriarchate is a pre-trial investigation.
